DCAMM is seeking a highly motivated and experienced attorney to join its Office of General Counsel to provide legal services, advice, and guidance to DCAMM’s Offices of Planning, Design and Construction, Access and Opportunity, Facilities Management, and other agency offices with respect to all aspects of major building construction and design activities, DCAMM’s Affirmative Marketing and workforce participation programs, and other agency activities.
The Deputy General Counsel will be expected to prepare high-quality memoranda, contracts, position statements and other documents; review important documents, including procurement documents and contracts under M.G.L. c. 149, ss. 44A-J, c. 149A and c. 30, s. 39M to ensure compliance with public procurement and other applicable laws; analyze and interpret applicable laws, policies and contract provisions; participate in meetings and decision making on relevant issues and undertakings; work collaboratively with agency leadership and staff on developing and enhancing agency programs and operations; and negotiate appropriate resolutions when disputed matters arise. The selected candidate will be expected to follow a hybrid work model that consists of both in-office and work from home days.
Detailed Statement of Duties and Responsibilities
- Provide legal advice to project teams regarding all aspects of DCAMM building construction and design projects.
- Review contracts, procurement documents, and other legal documents and make recommendations of any required changes to ensure compliance with M.G.L. c. 149, ss. 44A-J, c. 149A, c. 30, s. 39M, and other applicable laws.
- Represent DCAMM in dispute resolution, including alternative dispute resolution forums and at administrative hearings on assigned cases, and in certification and bid protest disputes, addressing claims against design and construction firms for recovery of damages attributed to negligent work or breach of contract and defending against claims asserted by design and construction firms.
- Work closely with the Attorney General’s Office on litigation matters and supervise outside counsel on various legal projects to ensure effective and efficient provision of legal services.
- Work closely with and provide legal advice to DCAMM’s Director of Access and Opportunity, Deputy Director of Compliance, and Deputy Commissioner of Finance and Administration to ensure all aspects of the agency’s Affirmative Marketing Program (AMP) for minority and women owned businesses and the Commonwealth’s minority and women workforce participation programs are developed and administered in manners consistent with applicable laws and jurisprudence.
- Manage the procurement, undertaking and oversight of agency Disparity Studies.
- Provide intradepartmental and public presentations on public procurement processes, DCAMM certification, the Affirmative Marketing and workforce participation programs, and other relevant topics.
- Respond to state, county, and municipal requests for emergency waivers from public bidding laws in a timely manner.
- Respond to the various inquiries from contractors, designers, public officials, state and municipal employees, investigators and the general public.
- Undertake legal research and prepare memoranda and other materials.
- Perform such other duties as requested and required by the General Counsel and/or other Deputy General Counsels.
