Duties Description:
The Office of Counsel provides legal counsel and advice to the Department, as well as other State government entities. As the Department carries out key initiatives to transform the way services are delivered to partner agencies and to the public, this position will play an important role in ensuring the success of these modernization efforts.
The Senior Attorney duties in Counsel’s office will include but are not limited to the following:
• Providing legal advice to the Department, State Civil Service Commission, State agencies, local governments, and other parties regarding all aspects of human resources and merit system administration touching upon the Civil Service Law and Rules and other relevant statutes. The Attorney may be expected to attend Commission appellate conferences and prepare appellate decisions for Commission review.
• Working independently on responses to Freedom of Information Law (FOIL) requests for review by the Department Records Access Officer.
• Serving as a liaison to the Office of the Attorney General for assigned legal matters to which the Department or State Civil Service Commission is a party. The Attorney will take part in the discovery process and the review and drafting of legal papers.
• Serving as liaison and advisor to the Office of Employee Relations regarding the interaction of the Civil Service Law and Rules and the negotiated agreements with the State employee unions. This includes matters involving attendance and leave and the out-of-title work grievance process.
• Drafting proposed regulations for promulgation pursuant to State Administrative Procedures Act.
• Performing legal research on issues as requested by the agency’s business units.
• Interpreting and researching pertinent case law, opinions and other legal sources in order to respond, both orally and in writing, to requests for legal decisions and opinions from internal staff and outside agencies.
• Other duties as assigned.
